The Government of Spain equates to residents and non residents of the country in reference to Inheritance and Donations tax.

The Spanish government change the law to abolish the tax discrimination.

It´s already working on the adaptation of Spanish legislation in reference to the judgment of the Court of Justice of the European Union September 3, which considers the Spanish legislation as contrary to Community Law considering restricting the free movement of capital discriminating non-residents in Spain and the Spanish people who receive or transmit assets abroad in relation to the law of Inheritance and Donations tax.

The Inheritance and Donations tax is transferred to the autonomous communities, which have regulated the tax assessment on introducing a number of reductions, rebates and exemptions that improve state regulation state tax.

Until the amendment, the Spanish law provided that before a succession or donation in which one party was a non-resident, this could not benefit from tax reductions provided in each community but the state rate applies assuming a lien (now considered illegal) to 35%.

Since the reform, European non-residents in Spain’s autonomous community tax rate at which the well is located higher value thereby failing to abide by the state system and disappearing tax discrimination apply.
